3.1 Each App may offer different features, and some features may be available only on certain plans, devices or regions. The App name, icon and listing shown on Google Play identify the App you have installed.
3.2 DeluxeWebApps is an independent software developer. References in an App’s name or content to a place, community or organisation are descriptive only. Unless an App expressly states otherwise, it is not an official service of, and is not endorsed by, any housing authority, developer, society, government body or other third party.
4. Eligibility and accounts
4.1 You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and capable of entering into a binding contract to use the Apps. The Apps are not directed at children under 13, and we do not knowingly collect personal data from them. If you believe a child has provided us with personal data, contact us and we will delete it.
4.2 Where an App requires an Account, you must provide accurate and current information and keep it up to date. You are responsible for all activity under your Account, for keeping your sign-in methods and devices secure, and for notifying us promptly of any unauthorised use.
4.3 You may give other people (such as staff or helpers) access to an App only where the App allows it, and you remain responsible for their acts and omissions as if they were your own.
5. Licence and restrictions
5.1 Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use each App on devices you own or control, for your own lawful personal or internal business purposes.
5.2 You must not, and must not permit anyone else to: (a) copy, modify, translate or create derivative works of an App; (b) reverse engineer, decompile or attempt to extract source code, except where Applicable Law permits despite this restriction; (c) sell, rent, lease, sub-license or commercially exploit an App; (d) remove or alter any proprietary notice; (e) circumvent security, licensing, usage or payment controls; or (f) use an App to build a competing product or service.
5.3 All rights not expressly granted are reserved by us and our licensors.
6. Acceptable use
6.1 You agree to use the Apps only in accordance with these Terms and Applicable Law. You must not:
- violate any law or regulation, or infringe the rights of others, including intellectual property, privacy and publicity rights;
- upload, transmit or distribute malware, or interfere with or disrupt the Apps, our servers, networks or other users’ use of them;
- attempt to gain unauthorised access to any Account, data, system or network;
- impersonate any person or entity, or misrepresent your identity, affiliation or authority;
- harvest, scrape or collect other users’ personal data without their consent and a lawful basis;
- use the Apps for fraud, money laundering, deceptive practices or any unlawful transaction;
- use the Apps to send spam or unsolicited commercial messages;
- use automated means (bots, scripts or crawlers) to access an App except as the App expressly allows; or
- encourage or assist anyone else to do any of the above.
7. User content and community standards
7.1 Your responsibility. Some Apps allow you to create, post, share or exchange User Content, such as messages, community posts, listings or business records. You are solely responsible for your User Content and for ensuring that you have all rights needed to submit it.
7.2 Prohibited content. You must not post or share User Content that: is unlawful, defamatory, harassing, threatening, hateful or discriminatory; promotes violence, self-harm or terrorism; is sexually explicit or exploits or endangers minors; is fraudulent, misleading or deceptive; infringes another person’s rights; discloses another person’s private information without consent; promotes illegal goods or services; or otherwise violates Google Play’s Developer Program Policies, including its user-generated content policy.
7.3 Reporting and moderation. Where an App allows users to interact or to see each other’s content, you may report objectionable content or behaviour to us at sales@deluxewebapps.com. We may review reports and may, in our discretion and without prior notice, remove content, restrict features, suspend or terminate Accounts that violate these Terms, and report unlawful activity to the competent authorities. We are under no obligation to monitor User Content.
7.4 Licence to us. You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, transmit and process your User Content solely as necessary to operate, secure, support and improve the Apps and to provide the features you use. This licence ends when you delete the User Content or your Account, except for copies held in routine backups for a limited period or that we must retain by law.
7.5 Dealings between users. Where an App enables users to list, advertise, find or contact one another (including any marketplace or community feature), we merely provide the technology. We are not a party to, and are not responsible for, any agreement, transaction, meeting or dispute between users, nor for the quality, safety, legality or accuracy of any listing or content. You deal with other users at your own risk and should take reasonable precautions.
8. App-specific terms
The following terms apply in addition to the rest of these Terms to the Apps named. If there is a conflict, the more specific term prevails for that App.
8.1 LPG POS Pro: Cylinder Ledger
(a) The App helps LPG cylinder shops record sales, customer credit, cylinder stock, suppliers, expenses and daily cash. Records and reports are produced from the data you enter. You are responsible for the accuracy and completeness of that data and for compliance with your own tax, accounting, licensing, safety and consumer-protection obligations.
(b) Reports, figures and statements generated by the App are for information only. They are not accounting, tax, financial or legal advice, and you should verify them before relying on them for business, tax or legal purposes.
(c) The App can work offline and synchronise when a connection is available. You are responsible for your device, for keeping the App up to date and for making and safeguarding backups. If you protect a backup file with a password, we may be unable to recover the backup or its contents if you lose the password.
(d) Statements, reminders and other messages are sent only when you choose to send them. You are solely responsible for the content of your communications with your customers and for having any consent or lawful basis required to contact them.
(e) A practice (demo) shop, where provided, contains sample data only and is kept separate from your real shop data.
(f) The App handles information about your customers. You are responsible for handling that information lawfully and in accordance with the notices you give to them.
8.2 Enclave Bazaar, Enclavians and Bahria Enclave Community
(a) To the extent these Apps allow posting, messaging, listings or other interaction, section 7 (User content and community standards) applies in full. You must be truthful in anything you post or offer, and must not use the Apps to harass, defraud or mislead other users.
(b) Any transaction, rental, service or sale arranged through an App is solely between the users involved. Verify the identity of the other party and the condition and lawfulness of any item or service before you pay or meet, and do not send money to people you do not know and trust.
(c) We may remove listings or content and restrict accounts that we reasonably consider to breach these Terms, to be unlawful or to put other users at risk.
8.3 Emergency Help Alert
(a) The App is not a substitute for contacting emergency services. In any emergency, you must contact your local emergency number or the relevant authorities directly. Do not rely on the App as your only means of seeking help.
(b) The App depends on your device, operating system, permissions, battery, location services, mobile or internet connection and the availability of the people or services you select. We do not guarantee that any alert will be sent, delivered, received, read or acted on, that location information will be accurate, or that anyone will respond.
(c) You are responsible for configuring the App correctly, keeping contact details current and obtaining the consent of anyone whose details you add. You must not use the App to send false, misleading or harassing alerts. Misuse may be reported to the authorities and may lead to suspension of your access.
8.4 Network Tools Pro and Port Scanner
(a) These Apps provide network diagnostic and port-scanning functions. You may use them only on networks, devices and systems that you own or for which you have the explicit, prior authorisation of the owner.
(b) Scanning or probing systems without authorisation may be unlawful and may breach the policies of network operators and service providers. You are solely responsible for ensuring that your use complies with Applicable Law, including cybercrime and computer-misuse laws such as Pakistan’s Prevention of Electronic Crimes Act, 2016, and the laws of any country in which the target systems are located.
(c) You must not use these Apps to gain unauthorised access to, disrupt, damage or collect data from any system, or to facilitate an attack. We do not endorse, and are not responsible for, any unlawful or unauthorised use, and results shown by the Apps are provided for information only and may be incomplete or inaccurate.
9. Subscriptions, payments, free trials and refunds
9.1 Free and paid features. Some Apps or features are free, and some are available only through a Paid Plan. Features and plan contents may change as described in section 19.
9.2 Purchases through Google Play. Paid Plans are purchased in the Android App and are billed and processed by Google Play. The price, billing period and any free trial or introductory offer are shown on Google Play before you confirm the purchase. We do not receive or store your payment card details. Your purchase is also subject to Google Play’s terms of service and payment terms. No payment is collected on our website or in a web app.
9.3 Automatic renewal. Unless the purchase screen states otherwise, a subscription renews automatically at the end of each billing period at the then-current price until you cancel. Taxes may apply as shown at purchase.
9.4 Free trials. Where a free trial is offered, access during the trial is as described at the time of the offer. If the offer converts to a paid subscription, you will be charged through Google Play when the trial ends unless you cancel before it ends. You can see the terms of any trial on the Google Play subscription screen.
9.5 Cancellation. You may cancel at any time in the Google Play app under Payments & subscriptions → Subscriptions. Deleting an App or an Account does not cancel a subscription. Cancellation takes effect at the end of the billing period you have already paid for, and you keep access to the paid features until then. When a Paid Plan ends, paid features may be locked, but your data is not deleted by reason of the plan ending.
9.6 Refunds. Refunds for purchases made through Google Play are governed by Google Play’s refund policy and are handled by Google. Nothing in these Terms limits any refund or cancellation right you have under Applicable Law. If you believe you were charged in error, contact Google Play and, if you wish, us at sales@deluxewebapps.com so we can help.
9.7 Price and plan changes. We may change prices or plan contents prospectively. Where required, we will notify you in advance and give you the opportunity to cancel before the change applies to you.
10. Advertising and third-party services
10.1 Free versions of our Apps may display advertisements supplied by third-party advertising networks such as Google AdMob. Advertisers and ad networks are solely responsible for their ads, and we do not endorse any advertised product or service. How advertising and similar technologies handle data is described in our Privacy Policy.
10.2 The Apps may rely on or link to third-party services and platforms, such as Google Play, Google sign-in, Firebase, SMS and messaging providers, mapping services and payment processors. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, their content, availability or practices.
11. Privacy, data protection and data deletion
11.1 We process personal data in accordance with our Privacy Policy. By using the Apps you acknowledge that you have read it.
11.2 Account and data deletion. You may request deletion of your Account and associated personal data at any time using our Data Deletion Request page. We will process verified requests within the period stated on that page, subject to any data we are required by law to keep.
11.3 Where you use an App to record information about other people (such as your customers or community members), you are responsible for having a lawful basis to do so and for complying with Applicable Law regarding that information.
12. Intellectual property and feedback
12.1 The Apps, including their software, design, text, graphics, logos, icons and names (such as “DeluxeWebApps” and the App names listed in section 3), are owned by us or our licensors and are protected by intellectual property laws. Except for the licence in section 5, no right, title or interest is transferred to you.
12.2 Third-party names, logos and trademarks, including Google, Google Play and Android, belong to their respective owners and are used only to identify them.
12.3 If you give us suggestions, ideas or other feedback, you grant us a perpetual, worldwide, royalty-free licence to use it without restriction or obligation to you.
12.4 If you believe that content in an App infringes your copyright or other rights, send a notice to sales@deluxewebapps.com identifying the material, the rights claimed, and your contact details, and we will review it promptly.
13. Availability, updates and support
13.1 We aim to keep the Apps reliable but do not promise uninterrupted or error-free operation. The Apps may be unavailable for maintenance, updates, security reasons, third-party outages or events beyond our control.
13.2 We may update, change, suspend or discontinue any App or feature, in whole or in part, from time to time. Some updates may be required to keep using the App. Where reasonably practicable, we will give notice of the discontinuation of an App you have paid for.
13.3 Support is available by email at sales@deluxewebapps.com. We will use reasonable efforts to respond, but we do not guarantee any response time.
14. Disclaimers
14.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPS AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE AND NON-INFRINGEMENT.
14.2 We do not warrant that the Apps will meet your requirements, be secure, accurate or free of errors, viruses or interruptions, or that any data will not be lost. You use the Apps at your own risk and are responsible for backing up your data.
14.3 Nothing in the Apps is professional advice of any kind (including legal, tax, accounting, financial, medical, safety or security advice).
14.4 Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. In that case, our warranties are limited to the minimum extent that the law allows, and your statutory rights as a consumer are not affected.
15. Limitation of liability
15.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DELUXEWEBAPPS AND ITS OWNER, CONTRACTORS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITY, DATA OR USE, ARISING OUT OF OR IN CONNECTION WITH THE APPS OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
15.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APPS OR THESE TERMS WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID US (INCLUDING THROUGH GOOGLE PLAY) FOR THE RELEVANT APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
15.3 We are not responsible for any loss arising from your failure to back up data, to keep your device or credentials secure, to follow instructions, or from the acts or omissions of other users or third parties, including those described in section 8.
15.4 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Applicable Law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
16. Indemnification
To the extent permitted by Applicable Law, you agree to defend, indemnify and hold harmless DeluxeWebApps, its owner, contractors and licensors from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your User Content; (c) your misuse of an App, including any unauthorised scanning or access to systems; or (d) your violation of any law or third-party right.
17. Suspension and termination
17.1 You may stop using an App at any time by uninstalling it, and you may request deletion of your Account as set out in section 11.
17.2 We may suspend or terminate your access to an App or Account, with or without notice, if we reasonably believe that you have breached these Terms or Applicable Law, that your use poses a security or legal risk, or that you have engaged in fraudulent or abusive conduct. Where practicable and lawful we will tell you why and give you a chance to respond.
17.3 On termination, your licence to use the App ends. Sections that by their nature should survive termination (including sections 5.2, 7.4 to 7.5, 12, 14 to 16, 20 and 21) will survive.
18. Google Play
18.1 You acknowledge that these Terms are between you and DeluxeWebApps only, and not with Google LLC or its affiliates (“Google”). Google is not responsible for the Apps or their content.
18.2 Your use of an App must comply with the Google Play Terms of Service and any other applicable Google terms. Google has no obligation to provide maintenance or support for the Apps, and, to the maximum extent permitted by law, has no warranty obligations for the Apps.
18.3 Google and its subsidiaries are third-party beneficiaries of these Terms insofar as they relate to your use of the Apps through Google Play, and may enforce them against you as such.
18.4 Any claim relating to an App’s intellectual property, product liability or legal compliance is the responsibility of DeluxeWebApps and not of Google.
19. Changes to these Terms
19.1 We may update these Terms from time to time, for example to reflect new features, legal requirements or business changes. We will post the updated Terms on this page with a new “Last updated” date, and, for material changes, will take reasonable steps to notify you (such as an in-app notice or an email).
19.2 Changes take effect when posted, or on the date stated in the notice. If you continue to use an App after the changes take effect, you accept the updated Terms. If you do not agree, you must stop using the App and may delete your Account.
20. Governing law and disputes
20.1 These Terms and any dispute arising out of or in connection with them or the Apps are governed by the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law rules.
20.2 Informal resolution first. Before starting formal proceedings, you agree to contact us at sales@deluxewebapps.com and give us at least thirty (30) days to try to resolve the dispute in good faith.
20.3 Subject to 20.2 and to any mandatory rights you have as a consumer, the courts of Islamabad, Pakistan have exclusive jurisdiction over any dispute not resolved informally.
20.4 If you are a consumer, nothing in these Terms removes the protection of mandatory consumer-protection laws of the country where you live, and you may be entitled to bring proceedings in your local courts.
21. General provisions
21.1 Entire agreement. These Terms, together with the Privacy Policy and any specific terms presented for an App or feature, are the entire agreement between you and us about the Apps and replace any earlier understanding.
21.2 Severability. If any provision is found invalid or unenforceable, it will be enforced to the maximum extent possible and the remaining provisions stay in full force.
21.3 No waiver. A failure or delay in exercising a right is not a waiver of it.
21.4 Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign them in connection with a merger, acquisition or sale of the relevant App or business, or to an affiliate.
21.5 Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, outages of power, internet or third-party services, labour disputes, government action or cyber-attacks.
21.6 Export and sanctions. You must not use the Apps in violation of export-control or sanctions laws that apply to you.
21.7 Notices. We may give you notice by posting on this page, through an App, or by email to the address associated with your Account. You may give us notice using the contact details below.
